Terms of Service

These Terms constitute a legally binding agreement between you and Festaiv. By accessing or using the platform — whether as a Festival Organizer, Filmmaker, or Attendee — you confirm that you are at least 18 years old (or the age of legal majority in your jurisdiction) and have the legal capacity to enter into this agreement.

Festaiv is a three-sided marketplace connecting film festival organizers, filmmakers, and audiences. We provide tools for festival discovery, film submissions, ticketing, check-in, ratings, and AI-powered recommendations. Festaiv is a platform — we facilitate connections but are not a party to the transactions between users.

Festival Organizers

• You are responsible for the accuracy of your event listings, including dates, venues, schedules, and descriptions
• You are responsible for your ticketing accuracy and refund policies. Festaiv is not liable for event cancellations or changes
• You must comply with all applicable local laws and regulations governing your events
• Festival subscriptions are billed according to the plan you select. We do not charge commissions on ticket sales

Filmmakers

• You retain full ownership of your intellectual property. By submitting content to Festaiv, you grant us a limited, non-exclusive, worldwide license to display, distribute, and promote your films and materials on the platform — solely for the purpose of operating Festaiv
• This license terminates when you remove your content or delete your account
• Festaiv is free for filmmakers. We will never charge submission fees
• You represent that you have the rights to all content you upload and that it does not infringe on any third party's intellectual property

Attendees

• You are responsible for the content of your ratings, reviews, and any comments you post
• Reviews must be honest and based on your genuine experience. Harassment, hate speech, defamation, and spam are prohibited
• Tickets purchased through Festaiv are subject to the refund policy of the respective festival organizer

Festaiv uses artificial intelligence to power recommendations, generate insights, and assist with content creation. AI-generated suggestions are tools — not editorial decisions. Festival organizers and filmmakers retain full control over their published content. Festaiv is not responsible for the accuracy of AI-generated recommendations or summaries.

All payment processing is handled by Stripe. Festaiv does not store your credit card numbers. By making a purchase, you also agree to Stripe's Terms of Service.

• Festival subscriptions are billed monthly or annually based on the selected plan
• Ticket purchases are processed at the time of checkout
• Refunds for ticket purchases are governed by the festival organizer's refund policy. Festaiv may facilitate the refund process but is not responsible for refund decisions

You agree not to:

• Use Festaiv for any unlawful purpose or in violation of these Terms
• Upload content that is infringing, defamatory, obscene, or harmful
• Attempt to gain unauthorized access to other accounts or platform systems
• Interfere with or disrupt the platform, servers, or networks
• Use automated tools (bots, scrapers) to access the platform without our written permission
• Create fake accounts, manipulate ratings, or engage in fraudulent activity
• Harass, threaten, or intimidate other users

You may delete your account at any time through your account settings or by contacting support@festaiv.com.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are inactive for an extended period. We will provide notice before termination when reasonably possible.

To the maximum extent permitted by law, Festaiv and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. This includes — but is not limited to — loss of profits, data, or business opportunities.

Festaiv's total liability to you for any claims arising from these Terms shall not exceed the amount you paid to Festaiv in the twelve (12) months preceding the claim.

The platform is provided “as is” and “as available” without warranties of any kind, express or implied.

If a dispute arises between you and Festaiv, we encourage you to contact us first at support@festaiv.com so we can try to resolve it informally.

If we cannot resolve the dispute informally, you and Festaiv agree to resolve any claims through binding arbitration on an individual basis, rather than in court. You waive the right to participate in a class action or class-wide arbitration.

Arbitration will be administered under the rules of the American Arbitration Association (AAA) and conducted in the State of Florida, in English.

We may update these Terms from time to time. When we make material changes, we will notify you via email or a prominent notice on the platform at least 30 days before the changes take effect. Your continued use of Festaiv after the effective date constitutes acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes not subject to arbitration shall be resolved in the federal or state courts located in the State of Florida.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
